Please read these Terms and Conditions, which apply to your use of this website.  If you do not agree to these terms, then do not use website. By using this website you accept the guidelines regarding use and participation contained herein.

Modifications

Papa John’s Guam may at any time, for any reason, and without notice or liability: (1) modify, suspend, or terminate operation of or access to this Website or any portion thereof; (2) change, revise, or modify this website or any portion thereof; (3) interrupt the operation of this website or any portion thereof for maintenance and support; (4) impose limits on certain features and services, or restrict access to the website; and/or (5) terminate the authorization, rights, and license given above.  Upon any termination, the rights and licenses granted to you herein shall terminate, and you must cease all use of the website.

Content And Use

This website and all content, information, and other materials featured, displayed, contained, and available on this website (collectively, the “Content“) are owned by or licensed to Papa John’s Guam and are protected by copyright, trademark, trade dress, patent, and/or other intellectual property rights.  Subject to your compliance with these Terms and Conditions, Papa John’s Guam grants you a personal, non-exclusive, non-transferable, limited right to access, use, display, and download this website for noncommercial purposes only.  You may not, in any way, otherwise copy, reproduce, distribute, transmit, display, perform, reproduce, publish, license, modify, create derivative works from, sell, or exploit, in whole or in part, this website or its Content.

You agree to use this website and the Content in accordance with these Terms and Conditions and all applicable laws and regulations.  Papa John’s Guam may prohibit access, use, conduct, communications, or content that we, in our sole discretion, deem to be harmful to this website, the Content, users, us, our brand, or any other person or entity, or that violates these Terms and Conditions and/or applicable law.

Online Ordering

Papa John’s Guam offers the Papa John’s Guam On-line Ordering (the “On-line Ordering“) to serve our customers better.  The On-line Ordering is available customers who are located in Guam. The use of the On-Line Ordering is an added service. There are no membership fees associated with the use of On-line ordering.

Eligibility:  You may use the On-Line Ordering if you: (1) are a legal resident of the Guam, U.S.A ; (2) at least 18 years of age at the time of use; (3) have an active, valid e-mail address; and (4) are a human being.  No corporations, partnerships, limited liability companies, or other legal entities can use the On-Line Ordering.

The On-Line Ordering is not targeted towards, nor intended for use by, anyone under the age of 18.  If you are under 18, you may only use the On-Line Ordering under the supervision of a parent or legal guardian who agrees to be bound by these Terms and Conditions.

Additional Terms:  Papa John’s Guam reserves the right to terminate your On-Line Ordering Account and/or your use of On-Line Ordering if we determine in our sole discretion that you have violated these Terms and Conditions, you have more than one (1) account, or that the use of your account is unauthorized, deceptive, fraudulent or otherwise unlawful. Papa John’s Guam may, in its sole discretion, suspend, cancel, or combine Online Ordering Account that appear to be duplicative, and may refuse to allow you to re-enroll in the On-Line Ordering.  Papa John’s Guam also reserves the right to “unregister” and make ineligible for the On-Line Ordering Account that has been inactive for 12 consecutive months. Inactive is defined as no orders made. Papa John’s Guam has the right at any time, with or without giving you prior notice, to:

  • end or cancel the Online Ordering Account and/or any specific Account;

  • change any Account or other On-Line Ordering service we offer;

  • change the requirements for the use of On-Line Ordering;

  • change the time you have in which to use On-Line Ordering; and/or

  • change any other feature of On-Line Ordering website.

If we end the On-Line Ordering service, Orders you have placed but not fulfilled will expire on the end date, and you may not place or resubmit your order after the end date.

Login And Registration

Certain features or services offered on or through this website may require you to complete a registration process and/or setup an account or login.  In connection therewith, you agree to (1) provide true, accurate, current, and complete information about yourself, and (2) maintain and promptly update your information to keep it true, accurate, current, and complete.  You are entirely responsible for maintaining the confidentiality of the information you hold for your login, including your password.  You agree to notify Papa John’s Guam immediately of any unauthorized use of your login, or any other breach of security. You may be held liable for losses incurred by Papa John’s Guam or any other website user or visitor due to someone else using your login as a result of your failing to keep your login information secure and confidential.

You may not use anyone else’s account or login information.  Papa John’s Guam shall not be liable for any loss or damage arising from your failure to comply with these obligations.

No Warranties

THIS WEBSITE THE CONTENT, AND THE ON-LINE ORDERING ARE PROVIDED  ON AN “AS IS”, AND “AS AVAILABLE” BASIS, AND  PAPA JOHN’s GUAM HEREBY EXPRESSLY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, ACCURACY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.  WITHOUT LIMITING THE FOREGOING, PAPA JOHN’s GUAM DOES NOT GUARANTEE THAT THE WEBSITE OR CONTENT WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

Limitations Of Liability

IN NO EVENT SHALL PAPA JOHN’s GUAM BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY DAMAGES (DIRECT OR INDIRECT) WHETHER IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE ARISING OUT OF OR IN CONNECTION WITH THIS WEBSITE (INCLUDING ITS MODIFICATION OR TERMINATION), THE CONTENT, ONLINE ORDERING, OR THESE TERMS AND CONDITIONS USE, WHETHER OR NOT PAPA JOHN’s GUAM MAY HAVE BEEN ADVISED THAT ANY SUCH DAMAGES MIGHT OR COULD OCCUR AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY.  BECAUSE SOME STATES DO NOT PERMIT THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, IN SUCH JURISDICTIONS, LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.

International Users

This Website is controlled, operated, and administered by Papa John’s Guam from offices within the Guam, U.S.A. We make no representation regarding use of this Website outside of the United States.  You may not use this Website or export any portion of it in violation of U.S. export laws and regulations.  If you access this Website from locations outside of the United States of America, you are responsible for compliance with all local laws.

Governing Law/Venue

This Website is governed by and subject to the laws of the Territory of Guam, USA and, where applicable, U.S. federal law, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction and venue of the courts located in Guam U.S.A for any disputes arising out of these Terms and Conditions, the website, or the Online Ordering. Notwithstanding this provision, you agree that Papa John’s Guam may apply for injunctive or other equitable relief in any court of competent jurisdiction.

Privacy

Please review our Privacy Policy (the “Privacy Policy”), which is incorporated herein and also governs your use of this Website, to understand Papa John’s Guam’s privacy practices.

General Provisions

All or any of Papa John’s Guam rights and obligations hereunder may be assigned to a subsequent owner or operator of this Website in a merger, acquisition or sale of all or substantially all of Papa John’s Guam’s assets.  If, for any reason, a court of competent jurisdiction finally determines any provision of these Terms and Conditions or any portion thereof to be unenforceable, such provision will be enforced to the maximum extent permissible so as to give the intended effect thereof, and the remainder of these Terms and Conditions will continue in full force and effect.  Papa John’s Guam‘s failure to act with respect to a breach by you or others does not waive Papa John’s Guam’s right to act with respect to that breach or subsequent or similar breaches.

Ability to Accept Terms of Use

You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use. In any case, you affirm that you are over the age of 18, as the Papa John’s Platform is not intended for children under 18. If you are under 18 years of age, then please do not use the Papa John’s Platform - there are lots of other great web sites for you. Talk to your parents about what sites are appropriate for you.

All content included on this interactive service, such as text, graphics, button icons, images and software, is the property of Papa John's Guam, a subsidiary of Papa John's International Inc. and is protected by Guam's relevant regulations on Intellectual Property Rights.

The content and software on this interactive service may be used as either or both of an informational or shopping resource. Order Requirements

Minimum amount, prep time and contact number. 

  • Minimum on-line order is $15.

  • Place your order at least One (1) Hour before the expected pick-up or delivery time.

  • Pick-Up or Delivery time will be confirmed upon contacting the customer.

  • Please provide a valid Guam Contact Number. 

Payment options for online orders.

  • Credit Card  : Visa, MasterCard, Amex, Diners, Discover

  • Paypal Account  (i.e. Debit Card, Bank Account, Credit Card linked to Paypal Account)

Payment option for the $4 Delivery Fee

  1.  For approved delivery locations – Paid online at time of order submission with Credit Card or Paypal account    

  2.  For delivery locations that require verification and approval, paid separately with Cash or Credit card

Order Pick-Up

When placing the order, please take note of the delivery and/or service areas and verify store hours.

Delivery Requirements

Delivery Orders

  • Delivery Orders are subject to approval.

  • Complete the Delivery Name and Address if your order is for Delivery.

  • There is a $4 Delivery Fee per delivery.

  • Payment  for the Delivery Charge will be collected separately if not paid with online order  (for approved delivery order)

  • Delivery is subject to Driver’s availability, store hours, delivery areas as well as terms and conditions of promotions, if applicable.

  • Take note of Delivery Time Cut-Off.  In the event of high delivery volume for any given day, delivery time cut-off may be earlier than normal hours. 

  • Delivery time will be confirmed upon contacting the customer.

ID Verification

  • The Customer may be asked to present a valid ID upon pick-up or delivery of confirmed orders.

  • If paying by credit card, Name on the Credit Card must match the Name of the Signer of the Credit Card Slip (i.e. Credit Card Account Holder must be present for verification)

Large Orders

Order of 30 or more pizzas must be placed and paid for at least 2 days in advance unless a prior approval from Papa John’s Guam Manager is obtained.

Order Submission

  • Order Changes cannot be made once submitted. Customer will be charged cancellation or change fee, should changes be made after order submission.

  • You must provide a valid local contact number. A Papa John’s Staff will contact you for order confirmation. If your contact number is not a Guam Number, you must call Papa John’s Guam within 10 minutes of placing your order online.

  • Be mindful of our store opening and closing hours. See 'Order Fulfilment' below.

  • Please review your order. Order cannot be changed, canceled or refunded once the order fulfilment process begins. See 'Cancellation and Refunds' below.

Order Fulfilment

Order Processing

  • Please allow ample time for us to confirm and process your order. Papa John’s Staff  

    will give you a call to confirm your order and/or verify order specification and payment information. Please make sure the correct contact number is indicated on your order.

If you did not receive a phone call from Papa John’s Staff, your order is not confirmed

  • For same-day pick-up of orders, on-line orders must be placed within the time frame of : One (1) hour after store opening and  One (1) hour before store closing in order to be confirmed.

  • On-line orders can only be picked-up within One (1) hour after store opening and  One (1) hour before store closing. Please refer to our Page for Business hours and Contact Info.

  • Orders placed outside of the business hours will be confirmed the next business day; within 2 hours after store opening.

  • Orders cannot be canceled once the order fulfilment process has started. In case you have to cancel your order, please see the cancellation and refund information on our Contact page.

Order Pick–Up

  • Your on-line order cannot be modified nor altered at the time of pick-up. However, you may place additional order in-store during pick-up time.

  • Please take note of our delivery/service areas. When placing the order, Select the store location that serves your area.

  • For Order Pick-Up, be prepared to present the following:

    • Order Confirmation and Payment Confirmation

    • Your valid ID and/or Valid ID of your authorized representative whose name is indicated on the “Notes” or “Special Instruction” section of the check-out page.

    • If Paid by Credit Card, Signer of the Credit Card Slip must match the name on the Credit Card used for payment.

    • Failure to comply with the above may result in delay of order pick-up.

  • Only confirmed on-line orders may be picked-up. If you placed an order on-line but did not get a confirmation from Papa John’s Staff, your order may not be picked-up.

  • Confirmed On-line orders may not simply be cancelled in-store. See cancellation and refund information on our Contact page.

Delivery and Service Areas

When placing the order, select the store location that serves your area and verify the store hours.

Refunds and Cancellations

Orders can be cancelled before the order fulfillment process begins. Once the order fulfillment has started, your order can no longer be changed or canceled.

If your order has been paid and you need to change or cancel it, You must contact us as soon as possible. Follow the following guidelines.

  • For order placed within the time frame of : after 30 minutes of store opening and 30 minutes before store closing, you must contact us within 10 minutes of placing the order to make changes or cancellation.

  • For order placed outside of store business hours or NOT within the time frame of : after 30 minutes of store opening and 30 minutes before store closing, please contact us as soon as possible and/or contact us on the following business day via phone call, no later than 15 minutes after store opening.

  • Orders that have been fulfilled but not picked up by the customer or his/her authorized representative may not be cancelled nor refunded.

  • Valid Order changes or cancellation will be confirmed by a Papa John’s Guam Manager.

Fees

A fee will be charged to the customer for order changes, cancellations and refund requests.

This fee is charged to cover the associated bank and/or credit card processing fees.

Refund

Orders that have been picked-up by the customer or the customer’s authorized representative may NOT be returned nor refunded.

Refunds do not apply to orders that have been fulfilled or where cancellation requests were made after the order fulfillment process has started.

We do Not issue a refund if:

  • Order was not processed due to factors within your control (e.g. order was not picked-up within the specified pick-up time and location, customer specified a pick-up time outside of the store business hours, customer selected the wrong flavor, customer failed to indicate customization request, customer provided erroneous or incomplete order information, delayed payment by customer or issues with order and/or payment verification i.e. customer name does not match with the billing name).

  • Order was not fulfilled in a timely manner due to exceptional circumstances outside our control (e.g. delayed by a natural disaster, order was placed within one hour or less prior to the expected pick-up or delivery time or order was placed outside of business hours and  customer did not follow the 48 hours advanced payment requirement for large orders thereby resulting in insufficient processing time for the order, cancellation request was not sent on time or was sent after the order fulfillment process has started).

Your satisfaction is our #1 priority. Therefore, you can request a refund for cancelled orders, if ALL of the following are met:

  • Your order has been paid and you  have contacted the store to  request a cancellation within reasonable time.

  • The fulfillment process for your order has not started.

  • Your order cancellation request was confirmed by a Papa John’s Guam Manager.

If all 3 of the above are met, You can submit a refund request within 7 to 10 days after your payment was made. You can do it by calling us AND by contacting us using our Contact Form and providing the information below. Once your refund request was received, allow 5 business days for us to contact you and process your refund.

  • Complete billing name

  • Valid email address

  • Valid Guam telephone number

  • The store you placed the order with

  • Date of the transaction

  • Time of the transaction

  • Online order number

  • Order status and completion, please choose one:

    • Wrong order

    • Wrong address

    • Order not made

    • Order not picked up

    • Unable to deliver

    • Other/no reason

  • Amount to be refunded

  • Last 4 digits of the Credit or Debit card used

  • Specify reason for request

  • Have you spoken to a Pap John's Guam Manager about this refund request?

    • If yes, please provide the Manager's name and date/time of the conversation

    • If no, a Manager will contact you

  • Any other information

Refund processing fee: 5% of amount to be refunded

* By clicking 'Submit' you agree to pay the refund processing fee of 5% of the amount to be refunded. In order to process the refund request, you may be asked to provide a valid Identification, the complete credit card information and any other documentation pertaining to the refund request.
